These Terms & Conditions (“Terms”) apply to the use of the Website and to every Order placed through it. By accessing the Website or placing an Order, the Customer agrees to these Terms.

These Terms are governed by Dutch law and are intended to comply with applicable Dutch and European consumer legislation. Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable law.

2. Definitions

For the purposes of these Terms:

2.1 Customer means any natural person acting for purposes outside their trade, business, craft or profession who places an Order through the Website.

2.2 Feromone means Feromone Fragrances, a sole proprietorship (eenmanszaak) established in Amsterdam, the Netherlands.

2.3 Fragrance Products means Feromone’s full-size perfume bottles only and does not include Fragrance Samples.

2.4 Fragrance Samples means Feromone’s sample-size perfume bottles.

2.5 Order means any purchase agreement concluded between the Customer and Feromone through the Website.

2.6 Personalized Products means Products that have been customized at the Customer’s request, including through engraving.

2.7 Products means Fragrance Products, Fragrance Samples, gift cards, and any other physical or digital products offered by Feromone from time to time.

2.8 Terms means these Terms & Conditions.

2.9 Website means the online store operated by Feromone and accessible via www.feromone.nl, including any associated webpages and services.

3. Applicability

3.1 These Terms apply to every offer made by Feromone and to every agreement concluded between Feromone and the Customer through the Website.

3.2 By placing an Order, the Customer confirms that they have been provided with these Terms in a manner that allows them to be stored for future reference.

3.3 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that reflects its original purpose as closely as possible.

3.4 Any deviation from these Terms shall only be valid if expressly agreed in writing by Feromone.

3.5 The Customer agrees that agreements, confirmations, notices and other communications relating to the Website or an Order may be provided electronically where permitted by applicable law.

4. Products

4.1 Feromone offers Products through its online store. Product descriptions, images and specifications are provided as accurately as reasonably possible.

4.2 As fragrances are composed from natural and synthetic raw materials, slight variations in colour may occur over time. Such variations do not affect the quality, safety or intended performance of the Product.

4.3 Product images are intended for illustrative purposes. Minor variations in appearance, packaging or presentation that do not materially affect the Product may occur.

4.4 Feromone reserves the right to modify, discontinue or replace Products at any time without affecting Orders that have already been accepted.

5. Offers, Prices and Orders

5.1 All offers made by Feromone are without obligation. Feromone reserves the right to amend or withdraw an offer at any time before an Order has been accepted.

5.2 Product availability is subject to stock. Placing Products in the shopping cart does not reserve them.

5.3 All prices displayed on the Website are stated in euros (€) and include Dutch VAT where applicable, unless expressly stated otherwise.

5.4 Shipping costs, if applicable, are displayed before the Customer completes the checkout process. Additional charges will not be applied without the Customer’s prior consent.

5.5 Feromone reserves the right to amend prices at any time. A price change shall not affect an Order that has already been accepted by Feromone.

5.6 An Order is placed when the Customer completes the checkout process and submits the Order through the Website.

5.7 After an Order has been placed, the Customer will receive an electronic confirmation acknowledging receipt of the Order. This confirmation does not constitute acceptance of the Order.

5.8 Feromone reserves the right not to accept an Order where reasonably justified, including but not limited to:

the Product is unavailable;
incorrect pricing or technical errors have occurred;
payment cannot be authorized or completed;
fraud, misuse, or other unlawful activity is reasonably suspected;
Feromone is required to do so by law.

Where payment has already been received for an Order that is not accepted, Feromone will refund the amount paid using the original payment method without undue delay.

6. Payment

6.1 Payment must be completed using one of the payment methods made available on the Website at the time of checkout.

6.2 Feromone uses external payment service providers to process payments securely. By placing an Order, the Customer acknowledges that payment information may be processed by the selected payment provider in accordance with its applicable terms and privacy policy.

6.3 The available payment methods may change from time to time and are displayed during checkout.

6.4 Ownership of the Products remains with Feromone until full payment has been received, to the extent permitted by applicable law.

7. Shipping and Delivery

7.1 Information regarding shipping destinations, shipping costs, estimated delivery times and delivery methods is set out in the Shipping Policy, which forms an integral part of these Terms.

7.2 Feromone aims to dispatch Orders within the timeframes stated in the Shipping Policy. Delivery times are estimates only and do not constitute guaranteed delivery dates.

7.3 Risk of loss of or damage to Products passes to the Customer when the Customer, or a third party designated by the Customer who is not the carrier, has taken physical possession of the Products, unless mandatory law provides otherwise.

7.4 The Customer is responsible for providing a complete and accurate delivery address. Feromone shall not be responsible for delays or additional costs resulting from incorrect or incomplete address information provided by the Customer.

7.5 If an Order cannot be delivered due to circumstances attributable to the Customer, Feromone may charge any reasonable additional costs incurred for re-delivery or return, to the extent permitted by applicable law.

8. Right of Withdrawal

8.1 Subject to the exceptions set out in these Terms and applicable law, the Customer has the right to withdraw from the agreement relating to the purchase of Products within 30 days without giving any reason.

8.2 The withdrawal period expires 30 days after the day on which the Customer, or a third party designated by the Customer who is not the carrier, has taken physical possession of the Product.

8.3 To exercise the right of withdrawal, the Customer must notify Feromone by email at info@feromone.nl before returning any Product. Feromone will provide the appropriate return instructions and return address.

8.4 The Customer must return the Product without undue delay and no later than 14 days after notifying Feromone of the decision to withdraw, unless otherwise agreed.

8.5 The Customer shall return the Product in its original packaging, together with any complimentary items supplied with the Order.

8.6 The Customer is responsible for all direct costs associated with returning the Product to Feromone, unless mandatory law provides otherwise. Returns sent without prior contact with Feromone may be refused or may delay the processing of the return.

9. Returns and Refunds

9.1 Returned Products must be unopened, unused and in their original condition. Feromone reserves the right to refuse a return or reduce the amount refunded where the Product has been handled beyond what is necessary to establish its nature, characteristics and functioning, to the extent permitted by applicable law.

9.2 Fragrance Products and Fragrance Samples that have been opened, used or otherwise tampered with cannot be returned for reasons of hygiene and product safety, unless the Product is defective or does not conform to the agreement.

9.3 If a returned Product satisfies the conditions set out in these Terms, Feromone will process the refund using the original payment method within 5 to 10 business days after the returned Product has been received and inspected.

9.4 Any shipping costs paid for the original Order will be refunded only where required by applicable law.

9.5 The Returns & Refund Policy forms an integral part of these Terms and provides additional information regarding the return procedure.

10. Personalized Products

10.1 Certain Fragrance Products may be eligible for personalization, including engraving.

10.2 Personalized Products are manufactured according to the Customer’s individual specifications and are therefore excluded from the statutory right of withdrawal to the extent permitted by applicable law.

10.3 Personalized Products cannot be returned, exchanged or refunded unless they are defective, incorrectly personalized by Feromone, or otherwise fail to conform to the agreement.

10.4 The Customer is solely responsible for ensuring that all personalization details submitted with an Order are complete and accurate. Feromone is not responsible for errors resulting from incorrect information provided by the Customer.

10.5 Personalization may require additional processing time. Any estimated preparation times are stated on the Website or in the Shipping Policy where applicable.

11. Gift Cards, Credits and Promotions

11.1 Feromone may offer gift cards, sample credits, discount codes or other promotional benefits from time to time.

11.2 Gift cards may be used as a payment method during checkout, subject to the conditions stated with the gift card.

11.3 Sample credits, discount codes and other promotional benefits are subject to the conditions stated with the relevant code or offer.

11.4 Unless expressly stated otherwise, promotional benefits cannot be exchanged for cash, transferred, or applied retroactively to Orders that have already been placed.

11.5 Feromone reserves the right to refuse, suspend or cancel a promotional benefit where misuse, fraud, technical error or violation of the applicable conditions is reasonably suspected.

12. Complaints and Conformity

12.1 Feromone is required to deliver Products that conform to the agreement.

12.2 If a Product is defective or otherwise does not conform to the agreement, the Customer should contact Feromone at info@feromone.nl as soon as reasonably possible after discovering the issue.

12.3 If a Product arrives damaged during transport or the Customer receives an incorrect Order, the Customer is requested to contact Feromone at info@feromone.nl as soon as reasonably possible after delivery. To facilitate a prompt resolution, the Customer should include the Order number, a clear description of the issue and, where relevant, photographs of the Product, parcel and packaging.

12.4 Feromone will assess the complaint and provide an appropriate solution in accordance with applicable law.

12.5 Nothing in this section affects the Customer’s statutory rights.

13. Use of the Website

13.1 The Customer may use the Website only for lawful purposes and in accordance with these Terms.

13.2 The Customer must not use the Website in any manner that may damage, disable, overload or impair the Website, interfere with other users, or compromise the security or proper functioning of the Website.

13.3 Feromone reserves the right to suspend or restrict access to the Website where misuse, fraud, unlawful activity or a breach of these Terms is reasonably suspected.

14. Intellectual Property

14.1 All intellectual property rights relating to the Website and its contents, including but not limited to text, images, photographs, videos, graphics, logos, trademarks, product names, designs, packaging, and other materials, are owned by or licensed to Feromone, unless stated otherwise.

14.2 Nothing in these Terms grants the Customer any intellectual property rights in relation to the Website or the Products.

14.3 The Customer may access and use the Website solely for personal, non-commercial purposes. No content from the Website may be copied, reproduced, distributed, published, modified or otherwise used without the prior written consent of Feromone, except where permitted by applicable law.

15. Liability

15.1 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

15.2 Feromone shall not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of revenue, loss of opportunity or other indirect damages, except where such limitation is not permitted by applicable law.

15.3 Feromone shall not be liable for any delay or failure to perform its obligations where such delay or failure is the result of force majeure (overmacht) as understood under Dutch law.

15.4 The Customer is responsible for using and storing the Products in accordance with the instructions provided by Feromone. Feromone shall not be liable for damage resulting from improper use, misuse, improper storage or use contrary to the provided instructions, except where such limitation is not permitted by applicable law.

16. Privacy

16.1 Feromone processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).

16.2 Information regarding the collection, use, storage and protection of personal data is set out in the Privacy Policy, which forms an integral part of these Terms.

17. Entire Agreement

17.1 These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between Feromone and the Customer regarding the use of the Website and the purchase of Products, unless mandatory law provides otherwise.

18. Governing Law and Disputes

18.1 These Terms, the use of the Website, and every agreement between Feromone and the Customer shall be governed exclusively by Dutch law.

18.2 Nothing in these Terms limits any mandatory rights granted to consumers under applicable law.

18.3 Any dispute arising out of or relating to these Terms or an agreement between Feromone and the Customer shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
